Emulators aren't. Downloading ROMs is. And even then, you need a warrant to see if the person had the game or not.

Assuming that the game isn't "in plain view."

To my understanding, if an officer is allowed into your house by you because of a domestic disturbance in your house and you just happen to have the game open on your computer and it's rather evident that it's a ROM, then you have some major problems.
